A Baltimore man who police say fired shots at a state trooper during a traffic stop Tuesday morning was a med tech at the Potomac assisted living facility where an 87-year-old was shot and killed on Valentine’s Day, according to court documents.

Maurquise Emillo James, 22, was charged with both crimes — the attempted murder of the trooper and first-degree murder in the death of Robert Fuller Jr., a philanthropist who had self-published a murder mystery.

James also tried to evade police by wearing a wig and a mask, and accessed the assisted living victim by disabling an alarm and propping open a door with a paper towel, according to the charging documents.

Officers arrested James in downtown Rockville on Tuesday afternoon after he attempted to flee and hours after he fired two shots at the state trooper in downtown Baltimore and drove away, police said at a news conference Wednesday. He was also charged on weapons and assault counts.

Maryland State Police said he is being held without bond in Montgomery County.

Fuller’s body was found with a gunshot wound to the head in his apartment at the Cogir of Potomac senior living facility on the morning of Feb. 14. Investigators said they collected a 9 mm casing from the scene.

James, who had been working at the facility since October and administered medication to residents, visited Fuller’s apartment twice on Feb. 13, according to charging documents. He gave medication to Fuller and a resident who shared the apartment but slept in a separate bedroom.

That resident told police they found it odd that James returned to the apartment that night to ask if their prescribed medication, Oxycodone, had kicked in. The resident said they hear well but did not hear a gunshot.

Detectives said tipsters helped identify James after Montgomery County Police released a video of a suspect last week. Former colleagues said the suspect’s jacket looked like one James had worn to work.

Shots fired at state trooper

Around 3:30 a.m. Tuesday, a trooper pulled over a gray Infiniti registered to James for speeding and driving without lights or tags in Northeast Baltimore.

When the trooper approached the driver’s side of the vehicle, state police said, the driver opened his door and fired two rounds at the trooper. The driver then fled the scene.

Shell casings collected from the scene matched the one collected from the Potomac senior living facility, said Sean Gagen, head of major crimes for Montgomery County Police. A relative of James who was driving a second vehicle alongside the suspect’s confirmed he saw him get pulled over and flee.

The injured trooper was transported to a shock trauma center and released later Tuesday, according to a state police news release. In an emailed statement, they said the trooper “narrowly escaped the gunshots” and suffered powder burns from the proximity of the shooting.

James told officers his relationship with Fuller was “very, very good” and he’d “never want to hurt” him, Gagen said.

Gagen said there needs to be additional investigation to understand who James is and what his motive was.

The maximum penalty for the first-degree murder charge is life in prison, authorities said. The murder case will be tried first, and then James will be transferred to Baltimore to face trial on the other charges.
