A Montgomery Circuit Court judge sentenced a Silver Spring man to 75 years in prison for the 2022 shooting death of 19-year-old Willians Anderson Alberto Cruz.

Friday’s sentencing hearing was the fourth in a case in which Alberto Cruz and several others had been fired upon on Nov. 9, 2022, as they stood outside a car on Colony Road in Silver Spring, listening to music.

Judge Terrence McGann sentenced Jonathan Leon-Chacon, 28, of Silver Spring, who had pleaded guilty to second-degree murder, attempted second-degree murder, use of a firearm in the commission of a felony, and participation in a criminal organization resulting in death.

Alberto Cruz, of Hyattsville, died at the scene. Two other victims were treated for gunshot wounds and a fourth escaped without a gunshot wound.

Montgomery County Police had identified Leon-Chacon and the other three defendants as members of the MS-13 gang. Prosecutors said they shot at the victims because they believed — incorrectly — that they had defaced gang graffiti in the forested area next to the parking lot where the shooting occurred.

Junior Francisco Del-Cid, 21, of Takoma Park, and Elmer Lopez-Cortez, 26, of Silver Spring, opened fire on the victims as Elvin Guzman-Machado, 26, of Boyds, and Leon-Chacon waited in the getaway vehicle.

In February, Lopez-Cortez and Del-Cid were sentenced to several life sentences without the possibility of parole.

“The victims in this case did not know the defendants,” Montgomery County State’s Attorney John McCarthy said after that sentencing.

Three weeks later, Guzman-Machado was sentenced to life plus an additional 40 years in prison.
